View Full Version : Constitutionality of gunshow waiting period.

It seems kind of peculiar that they are even trying to pass a background check with a waiting period (technically it is a minimum time for background check to be done) when the Supreme Court just a couple of years ago ruled that background checks were illegal. The ruling was based on the fact that background checks imposed by the federal government were an unfunded mandate and violated the tenth amendment(heaven forbid the Supreme court ever recognize the second amendment). As a matter of fact sheriff Jay Printz from Ravalli county, Montana was one of the primary plaintiffs in the case. Of course 99% of the police departments happily ignore the ruling and law that was handed down by the highest court in the land, the law they are sworn to uphold (which is why when they ask for donations to the policeman's ball I tell them to f**k off). This waiting period and background check is almost identical and by court precedent would almost be considered right out of the gate unconstitutional. It's real cute that the scumbag antigunners are going for a three day period for big brother to get the check done. They know that the police departments will procrastinate and take all 72 hours before they get the check done, basically preventing anyone from buying a gun at gun show which coincidentally last three days. Just think of it, you are a person who can legally own firearms, most shows open on a Friday afternoon and end by Sunday afternoon. Even if you buy a gun from a dealer or private party Friday afternoon as soon as the show begins, the govt. can wait till Monday afternoon until they approve of the sale. By then the guy who had the gun is probably on the road back home if he was from out of town. As far as sales on Saturday or Sunday (when most of them occur), you can forget it! The real intention of this law is eliminate gunshows and knock out another segment of FFL dealers, oh I mean "protect the children". Even the 24 hour period will discourage alot of people from attending, such as those who are there for one day, perhaps from out of town. The Republicans will probably get the 24 hour period passed, but that's just to give the illusion that they are progun. They are not, many Republicans voted for the 94' crime bill, "it just had too many good provisions in it that outweighed the bad" they say. I can't think of one good provision in the whole bill. Republican President George Bush was the most traitorous. His 89' import ban was the thing that got the whole gun control movement rolling. Prior to this Sarah Brady and her bunch had not achieved in sucessfully sponsoring a single federal law. Don't expect Bush junior (most likely 2000' winner at this stage) to do a thing to repeal any if the ridiculious laws regulating what kinds of guns and mags you can own, or other federal intrusion of your gun rights. All I can say is vote Libertarian, until maybe Jesse Ventura decides to run for President. If eight years down the road, he runs and wins, this country might have a prayer in Hell.

I will not vote for the little Bush.
His Dad turned on us and I am sure that he will do the same,
The Body would make a great man in the White House. I am also a Libertarian and hope that one day we will have power in our Country.
I take the extreme opinion when it comes to gun ownership in American, meaning ZERO gun-control. Some do not see it my way and I do not try and change their minds.
I don't see why some are celibrating this victory in the House. It is just another control and a added fee at a show when we buy guns. It does nothing to address youth crime and the problems that affect our kids.
We have lost a little more again and we are no more safer than we were yesterday.

Jesse Ventura would make a great president. I hope he runs so I can finally go to my local voting station and cast a vote that might actually make a difference in the quality of life in our country. Jesse Ventura can help start the ball rolling towards returning this country to its rightful owners, "We the people...".

Yeah I agree with the statement regarding evil. How long are we going to continue to allow those high paid people in D.C. to get personal about our Constitution? They seem to think and act on their own when it comes to making critical decisions regarding the law of the land.
I feel that in the not so distant future we very well may have to choose and stand.
"We the people........".

Back in '94 after the passage of the Brady Bill and prior to the passage of the "assault weapons" ban,people in my area got VERY active.We held meetings,held demonstrations, and picketed opposition candidates.We took out a full page ad in the newspaper stating our views on the second ammendment.You get the picture.Unfortunately,this activism was short lived.We've got to stay on top of our reps in D.C. and our state capitols.Losing our rights is far easier than getting them back.The problem is that it's hard to get people excited before it's too late.Defending our liberty has to be a full time concern!

Well it appears that we escaped by the skin of our teeth on this one, but its not a dead issue yet. If this legislation rises from the dead a couple weeks from now I wouldn't be surprised, it wouldn't be the first time. Stay alert and always check your six, there might just be a congressman ready to stab you in the back when you least expect it.
