CampyBob,
You can get forms right from the atf web site. You will need fingerprints and a picture. You need the serial number. You will need your CLEO to sign off. But most imprtantly you will need a cashiers check or Postal Money order for $200. Over the years whenever i called regarding a tranfer the most common question I have heard from ATF is "Did you send the check?"

What is the best way to coordinate the approval/build process if having an out of state class 2 dealer build it? Am I correct in thinking that I could ship him everything, and he could build it prior to me getting the form 1 approved? Once it is completed, the class 2 then has to ship it to a class 3 dealer in my state since it would then be an NFA item, correct? Is there another waiting period for the dealer to dealer transfer approval as well? In fact, if the builder is finished with it prior to me form 1 approval, he could still transfer it to the class 3 dealer in my state, I just couldn't take possession of it myself until I got the canceled tax stamp - correct?
Sorry for all the questions...
Brian

your best bet is to send everything to the class 2 manufacturer of your choice and have him register it on a Form 2(?) and transfer it (if necessary) on a Form # to the class III dealer in your state. Then you would do the Form 4 tax paid transfer to you. The class 2 manufacturer would have to register the gun anyway, if your Form 1 had not yet been approved. Also, registering it yourself on a Form 1 would require transhferring everything to the manufacturer on a Form 5 to be built.
Best to let the builder register it and you treat it like a straight NFA purchase.

Hmmm... I would need a form 5 to send the stuff to a class II, even if it was just a kit + receiver, and not a complete gun? If the class II registers it, would I then need to pay an excise tax as well? Would it be simpler (if not expedient) if I just waited until my form 1 was approved to send it off?
Arg - all these forms make me sick...

Or what we and many other smith have done is wait until your Form 01 is approved, then send your parts and a copy of your Form 01. You don't have to use a Form 05 to transfer a firearm to a gunsmith for repair/building any longer.
(see; http://www.atf.treas.gov/breakingnews/templates/breaknews.htm ) It is normally required that the client send a written and sign letter with a copy of his Form 01 requesting services to be rendered.
