View Full Version : Krink US Parts Legal Question
Saw this over on the Bower's Board. They are debating if SBR's require the necessary # of US parts. I was under the impression that you needed to keep the US parts. Anyone have experience with this?

Yes its true. A postban SBR does not require any usa parts. Here is a link to ATF letter on Bardwells site.

But for those that just can't accept this, if it makes you feel better, there's no harm if you do install usa parts.
But 922v still applies. only one evil feature. Pistol grip for example. No folding stock, threaded muzzle of flash hider.
Best to start with a pre 89 ban weapon to avoid this mess.
Interesting, very intersting!

According to the ATF guy I talked to at NFA brach (202)-927-8330 an SBR built on a postban reciever does indeed have 922R apply.....Maybe this guy doesn't know shit from shinopla but that's what I was told......As far as the Bardwell letter take a look at the date....Much could be "reinterpreted" since then if it is the letter I have seen....

On a post ban SBR, no US parts are needed, Only 1 evil feature, though. SBR's are still considered Title one firearms, just registered. MG's are in a class of there own.

no usa parts are required. even a postban rec. can still have a folding stock and a flash suppressor.

think of it this way: when you register a SBR, you are in effect "manufacturing" a new rifle, which removes the "sporting purposes" requirements and restrictions as exist on imported rifles. However, you ARE "manufacturing" a semi-auto rifle that comes under Assault Weapon regulations. So, for registered SBR, no USA parts requirement, but pre/post-ban rules apply. Also, don't believe ANYTHING you hear over the phone from ATF. I think it's easy to understand that any info they give you that can't easily be brought up in court will be as restrictive an answer as possible. If you want to be sure, get it in writing, and then verify THAT info independently.
