Bad stuff going on in Montana. this was a great guy, operatin WELL within the law, helping people do what most of y'all do anyway. making our own guns from flats or 80% recievers. Senator Burns is up for re-election this year in a hotly contested race with some Dem's call him in DC at 202-224-2644 or send a fax at 202-224-8594. dennis rehberg (rep)is also up for re-election call him at (202) 225-3211. check out the JFPO website for a news release and post a link here if you can

Looks like they didn't make anything other than 80% recievers to me. Capricious and Arbatrary action by BATFE mabee? I'm sure JPFO will keep on top of this one.

thanks for poisting those Steve. The main jfpo page has an alert right on the top center of the homepage, but the second link you've got is about verbatim. This really is a capricious action by both the fbi and atf (they both were there to my understanding). I.ve been on the phone all day raising hell with my reps and senators. lets keep the heat on. a little work by us now can save this fella a lot of heartache and cash later!!

Dillon gun parts manufacturer raided by ATF agents

DILLON -- Federal agents seized inventory and paperwork in a raid of a gun parts manufacturing company here last week, the company's owner said.

Federal officials wouldn't comment on the June 7 raid at KT Ordnance, which sells nearly finished gun parts over the Internet.

"We haven't been charged with any crimes and obviously what they found here didn't violate any laws, because I would have been arrested on the spot," said KT Ordnance owner Richard Celata, 45. "They confiscated all my inventory, paperwork and made copies of my hard drive."

Celata manufactures gun parts at his shop near Argenta, about eight miles west of Dillon. The parts that Celata builds are what he calls the "80 percent" market, meaning they're close to finished.

But they're not gun kits similar to those available through mail order catalogs that can simply be put together and ready to shoot, Celata said. Those require a license, whereas manufacturing gun parts does not as long as the buyer uses them personally and doesn't sell the guns once they're completed.

Celata's product requires some manufacturing work by the buyer, he said.

"There's no way to assemble this in any way that you can fire it," he said. "You have to actually do some machining."

Celata's lawyer, Quentin Rhoades of Missoula, said if Celata is charged with a crime, the government's case will come down to 'what constitutes a gun.'

Rhoades, who has represented the Montana Shooting Sports Association in other gun cases, said Celata did not intend to sell illegal firearms.

"It's legal to create your own firearm, as long as you do it yourself," Rhoades said. "He would provide instructions on how to complete that process, but he would not do it for you."

The so-called 80 percent market of gun products is a legal undertaking that the Bureau of Alcohol, Tobacco, Firearms and Explosives is well aware of, Rhoades said. And Celata is well known because he's one of the leading manufacturers of those products, but there are several other people selling similar gun parts.

"They've been wanting to shut down the 80 percent built market for a while, but they'd have to change the Constitution to do that," Celata said. "Or they can just raid you and scare everybody away."

Celata's Web site says the company has been raided by the ATF and is not taking orders.

A Montana gun-kit dealer's home was raided by FBI, BATF, and Canadian law enforcement agents, after he gave "subversive" literature to his local Sheriff, according to a story posted on an online news site.

After distributing his handouts to the local Sheriff, Richard Celata reportedly got a phone call asking him to "come in" for a meeting, scheduled the day after the local elections. When Celata arrived at the office, he found the place half-full of BATF and FBI agents, who handed him a warrant to search his home. However, Celata noticed the warrant contained "no signed affidavit," and was thus invalid. He was told the affidavit though it did exist, was "secret and sealed by the court."

The raiders claimed five of the pistols found on the premises "were used to commit murders in Canada," without further elaboration of details. In addition, Celata was reportedly questioned about his ownership of such dangerous materials as the Citizen's Rulebook and speeches by George Washington. He was also questioned about "specific individuals in the freedom movement, including JPFO's Aaron Zelman, author Devvy Kidd, and constitutional attorney Edward Vieira." (The story notes that only by accessing his e-mail account, could the authorities have known of his interest in these individuals.) After a lengthy interrogation, Celata's entire inventory of 80 percent finished gun frames was confiscated, and his computer's hard drive copied (and crashed).

ATF is trying to put a stop to our hobby of building personal firearms. From what I have read on another site, Richard Celata is trying to restart production as ATF said he can, but still has his stuff confiscated. He is also in some deep debt to his lawyers, which I am sure makes ATF very happy.

Not sure if he is still planning his "in your face" to ATF tomorrow.

This anti-American, anti-constitution crap has to stop!

The ATF is crumbling and they are going after anything they can to try to make a splash before their relevance(or irrelevance)becomes public knowledge.

It all comes down to the oath of office that all federal workers take, and for some reason, their swearing to uphold the constitution does not include the second amendment. With the exception of collecting taxes on firearms, ATF is a violation of the second amendment in themselves.

As of July 26, he said that he is restarting production of 80% receivers, and is hoping the "thieves" stay away. Mr. Celata is doing a great job staying afloat as the fed is trying to break him financially. Unfortunetly his lawyers are making money thanks to the opponents of "shall not be infringed".
