I was talking to a friend in Md that I know and he was telling me about a firearm purchase he was about to make at a gun shop, he told me he was filling out the paper work when the sales man ask him if he was ever arrested and he said yes ( a misdemeanor) well to make a long story short he was told that he was not allowed to make a hand gun purchase because of that ,is this true ?

That does not sound right at all.....if you are arrested for a Misdemeanor no way, but if it is a Felony then forget it. If you have an arrest for spousal abuse well the question is right on the form.

Not totally sure about it being a law, but I think a dealer has the right to refuse a purchase if he is not 100% comfortable with it. However, if the background check were conducted and everything checked out with that, then the dealer is off the hook. From the sounds of it, the dealer didn't bother going that far... Retailers are really being scrutinized for any firearm/ammo/accessory sale they made if a crime were committed with something they sold. I know WalMart, here, is requiring signatures and driver's license proof on all ammo sales because a murder was committed in VA and they traced the ammo back to a MD WalMart. Everything was done legally as far as sales went, but WalMart is doing a CYA approach now. I'm sure all MD dealers received a memo from the St. Police about watching their sales from now on. MD is going totally crazy on everything gun-related now...trying to beat Massachusetts and CA...and coming very close to it...
