Need details on how to transfer a F/A firearm from a father to son.
1. Does it have to go through a dealer?
2. Can you just do the form 4 with signatures, photo and prints and the $200.00
for just between families or is it a different form?

Yes, you have to go through a Class III dealer, YES YES. Just inform him that your father is just wanting to transfer the ownership to you.

Most dealers I know, would do something like that for about 50 to 75. fee when they normally do it for 100.

The reason is the ATF do not trust us with the hanling of the paperwork, yes you will still have to get the signatures and photos and have a dealer sign off on it as well.

Thanks for the info, I wish it was for me, But alas it is not. I was asking for a friend of mine whose Dad has a F/A mac 9 he wants to give him. I think he has a silencer for it too. I guess that would be double the forms and money.

A gun and a silencer which are two separate items each require a form 4 and tax. Two individuals CAN transfer without a dealer as long as they are in the same state. However, a dealers advice might be well worth his fee. If you actually transfer to the dealer then to new owner tax will payable TWICE ie once per form 4 transfer. Be absolutely certain form is done correctly!!

In the event of death of a registered owner the transfer to the estate is tax free.

Certain states have regulations in addition to the ATF and can generally be found in the state laws or a good dealer. (Earns his fee - again!)

You can transfer from father to an out of state son in the case of an inheritance without a dealer I think. The big issues here are where does each reside. Does the son reside in the same state as the father living or dead? If so no dealer is needed, this is simply a form 4 transfer, in the case of an inheritance no transfer tax is needed.
