well, as I posted in the general forum, here is what I have been able to find out on this subject......

does this mean that C&R handgun purchases are legal in NY?..also could you send info about your orginization..thanks...Mike

It is generally legal for a C&R FFL to transfer a handgun into NYS providing he or she also has a valid NYS firearm (handgun) license.

A NYS handgun licensee who is also a C&R FFL may accept delivery of the handgun only after obtaining the purchase authorization (document or coupon) from your county handgun licensing agent.

The procedure I follow is to have the seller of the handgun fax or mail me a bill of sale, stating the make, model, caliber, serial number, and any other info you need to get a purchase document. Then I take that bill of sale to my county licensing agent, and obtain a purchase authorization. I list myself as seller, using my FFL number, and myself as buyer, using my NYS pistol license ID number. I also give them a copy of the bill of sale and an extra copy of my FFL, if they want it. Once I have the purchase authorization in hand, I contact the seller and have them ship the gun to me. Once I get the gun, I take it back to the county licensing agent and have it added to my NYS handgun license.

There may or may not be some local administrative hurdles. For example, in NYC they will apparently not issue their handgun licensees a purchase document to allow a C&R FFL to put the handgun on his pistol license. Other counties may have other quirks, so you should contact your issuing agent to find out their requirements before buying an out-of-state handgun.

The one thing you should not allow them to tell you is that it is somehow illegal to bring in a handgun on a C&R FFL. NYS DCJS confirmed that it is legal as long as the transferee has the state pistol license and the purchase authorization before taking delivery.

Need I say why you could never get me to move to New York..... or California for that matter. (Ex native Californian and proud of it...mostly the "Ex" part).
