    restrictions........

    What are the restictions on giving a firearm away? Are there probs with the feds?
    What should be the level of info you collect or collect none at all?

    The only restriction would be if the person you give the firearm to is banned from having second amendment rights. Felon, Lautenberg, etc.

    It you are worried about the future, you could make a record of who you gave it/them to, but other than that, there are no true issues. (other than the fact that the fed wishes no one had heard of the second amendment)

    As stated, no issue giving away a weapon provided;
    1. The person has no Felony record.
    2. The person has not been convicted of domestic violence, stalking, threats against a woman / girlfirend.
    3. Is not currently under inditement for any of the above.
    4. If a handgun 21 years of age or older.
    5. Not been judged metally incompetant.

    What I would take down is a photo copy of their Divers's license. Store in a safe place with the Serial number of the weapon that was given to the friend.

    Technically, giving or selling a firearm of any kind to someone over state lines requires an FFL transfer.

    Within the state, no restrictions but you are wise to get information about the person (copy of their dl) who you sell to and keep that record.

    As stated by others, if the person can legally purchase and possess the firearm they can receive it as a gift provided you both reside in the same state. Anything else requires a FFL transfer. You might also do well to write up something similar to a bill of sale only as a gift that way both you and the receiver have something showing the disposition and origination of that firearm.

    i was told by an ATF agent (whom i specifically asked about this subject) that a handgun may be given as a gift to someone between teh ages of 18 and 21 by thier parents as they cannot purchase one, but may legally own, use and carry one. (in SD at least)
