    I don't know the reason for the contact, but the guy sure turns around into the vehicle like he's going to get a gun rather than get a license and insurance. Glad he didn't get killed and all but if he did it intentionaly to provoke the response he got I hope it comes out in court, the officer could get a long term for this.

    that is messed up. I used to keep my wallet under the seat. a few years ago I got stopped by an officer and he said get out of the car, I knew what the stop was for and I got out and reached
    under the seat. when I stood back up I had a pistol aimed at my head. I said my wallet, my wallet and he told me " now that was stupid" that was 1980.

    Hmmm.....Thats tough to me. How do ANY of us know the guy is not going for a gun? Until he pulls out of the car? Cop screwed up, but I do not feel this was because of racism, or anything else. Cop obviously went a bit too soon. But I do not think the cop should go to jail.

    When pulled over by a cop: stay in the vehicle, roll your window down all the way (especially if you have tinted windows) and place both hands relaxed on the wheel at the 10 o'clock and 2 o'clock positions, in clear view of the officer at all times.

    DO NOT make any sudden movements, even if going for your glovebox to get your registration/proof-of-insurance, especially when it involves moving your hands to where the officer cannot see them, as if you're desperately going for a weapon.

    I'm no big fan of the police or their all-too-frequent abuses of power, but in this case I can certainly see why the state trooper reacted the way he did. Especially since most people keep their driver's license in their wallet in a pocket on their person, not just laying around or under the front seat of their vehicle.

    I saw the video several times on various sites. Honestly, I think that cop was justified to shoot. The guy DOVE into his truck door as if he were trying to grab a hold of something real quick (like a gun).

    Of course, it turned out that the guy was unarmed, but the way he acted (IMHO) gave the cop no choice but to assume a weapon was going to be appearing in the next instant.

    The cop was maybe a bit quick on the trigger, but then again he who shoots first lives longest.

    Damn, the victim was really stupid. He brought it on himself.

    If a cop had a weapon drawn on me, I would be damn sure that I had both hands clearly visible and I would verbally announce what I was doing (like "my wallet is in my left pocket - I'm getting it") then SLOWLY get the wallet, always making sure both hands are visible (or at least non-threatening).

    Why the cop even got involved in the first place, however, I have no idea. In the video he said "seatbelt violation", but then why was the cop PARKED, then backed up and approached the truck driver. You don't use a seatbelt when pumping gas.

    I suspect the real cause of the initial encounter was a case of DWB...

    The cop should be either:

    * Sent to prison for murder
    -- or --
    * Cleared of all charges and re-instated

    There is no in-between. And honestly the way the driver dove into his truck to get at "something", I can't blame the cop for assuming that it was a weapon. If he waited to visually verify a gun, he would have gotten shot (if the guy did have a gun).

    I think the cop had no reason to interact with the victim AT ALL, but once he did the victim put the cop in justifiable fear for his life and the cop used his weapon for legitimate self defense (IMHO).

    it was a different time. the cops, while they had to be careful I don't think they were as fearful.

    I knew this man and it was one of the reasons vests started being worn around here.

    Looks like a clear case of DWB to me.

    Here in Idaho, the legislature changed the law so that failure to wear a seatbelt could only be charged as a secondary offense. (Meaning it's not enough to pull someone over as a primary offense, but the extra $5 fine can be tacked on if found not wearing a seatbelt after being pulled over for a "legitimate" other offense, like speeding or not signaling a lane change or whatever.)

    Sounds like SC needs to update their laws.

    Idaho is not SC and if you are worried about seat belt laws talk to the insurance companies.
