The analysis I heard on this while at the gym was very encouraging. While the states winning the suit against the executive order is not a slam dunk, there is enough doubt in the government's (the President's) action to stop it before it starts. Funny it takes a judge to figure this out. I just read the Constitution and knew the President's action is unlawful.

WASHINGTON (AP) — The Homeland Security Department will cease preparations for a program intended to protect millions of immigrants from deportation in the wake of a federal court ruling halting it, Secretary Jeh Johnson said Tuesday.

Johnson said U.S. Citizenship and Immigration Services will stop working on plans to launch a program to protect parents of U.S. citizens or legal permanent residents from deportation until further notice.

I am not optimistic. I don't see how this decision forces Obama to direct DHS or DOJ to act in any way to support existing law.

Actually, it doesn't force Obama to do anything. From what I understand, since it's now a suit in Federal Court, no actions by any party can be taken until the suit is settled. This means that Obama's EO on immigration is null and void right now. IF a higher court overturns the lawsuit, then Obama can continue with his original intent, but, if the court sides with the plaintiffs, then The EO, as written, is dead and can't be acted on.

Since the Judge, issuing the lawsuit, has written about Obama overstepping his legal authority (an illegal action), if a higher court sides with the plaintiffs, more actions against Obama's use of EO's may come under scrutiny... One can only hope...

It just takes one domino to start the rest falling...

EOs don't become "legal" untill a certain time has passed since they were decreed or if congress acts on them. There's also some thinking on the idea that eos aren't really legal especially in the case where the constitution is used to violate itself.
