    Albuquerque, NM — Albuquerque, New Mexico is home to some of the world’s most dangerous cops. After a recent federal appeals court ruling this week, the world now knows why they are likely never held accountable. In typical police state fashion, the court upheld the arrest and charges of a 13-year-old child — for burping in class.

    In what sounds like a piece from the Onion, the 10th circuit court of appeals ruled that the cop who arrested the child and the school staff were entitled to ‘immunity’ from any lawsuit filed against them on behalf of the child. The law the court cited in their ruling prohibits anyone from interfering with the educational process.

    The original incident happened in May of 2011 at Albuquerque’s Cleveland Middle School. After repeatedly burping in class, instead of simply disciplining the child, the school called the cops. The 13-year-old boy, who was in 7th grade at the time, was then searched, arrested, handcuffed, and brought to jail — for burping.

    There may be more to this story than what has been reported.

    IF that kid had been a constant trouble maker and was burping just to irritate the teacher and disrupt the class (in other words, if this kid were a perpetual asshole in class and was just trying to get a rise out of everyone), then I can see this happening.

    IF that were the case, then I would say the teacher finally got tired of his shit and threw it back at him. He may have gone too far this time.

    His parents are, probably, ones that never taught him right from wrong, never spanked him, and never held him accountable for his actions (true liberal Dimocrats). And, whenever the kid got in trouble, it was always someone else's fault.

    After 42 years in the classroom, I've seen plenty of assholes that I would have loved to have called the police on, but I preferred to keep them there and make their life as miserable as I could in the time I had them.

    I say there's a lot of background history that's been left out.

    This sounds likely, even in todays zero tolerance bullshit world, it's hard to believe an inadvertent burb would lead to an arrest

    This is why corporal punishment should be allowed. Then there is not need to call the cops.

    That is how Jered Laughners are created. I agree with public humiliation, but to make national news for getting arrested in class for burping.....is flat out ridiculous.

    Based upon this, the government has absolute control of your children's actions while at school, and there is no legal course of action if they are wrongly arrested.

    None of this would be problem if we would admit that none of us has a right to force our neighbors to send their children to a government indoctrination center, or to force property owners to pay for it.

    If the market were set free we would have enough money to pay for the education of poor people through voluntary means.

    100% agree Alismith. As a fellow teacher I could not agree more. I had an illegal immigrant mexican freshman boy in a class last year. Gang member, really smart, but a total asshole. High a lot of the time. Took a while, but eventually he came to just sit in the back and vegetate. Either that or it was constant sending to the office, writing up. I would rather have him in class, on the OFF CHANCE that some subject would inspire him, and not have to deal with the constant crap of disciplining him.....I decided as long as he did not disrupt, fine. Be a vegetable.

    Still an asshole. My prediction is that he will end up murdering or seriously hurting an innocent person someday.

    Side note. Had two former Hispanic male students shot to death last year. Within two weeks of each other. One was a kid dating a senior girl, also Hispanic, of mine that I was very close to. She dated him for about 10 months right up to his death. Kid dropped out at 17. Early on I gently tried to talk to her about him. Her worth, what she wanted to do in life, what her options were, her potential.....I did, at one point, tell her that the guy was not deserving of her in my opinion. Begged her to go to college. Spent hours and hours talking sense to this girl. Then I stopped. Had said enough. Then, he is shot, and the news says it was gang related, which she denied. Said he had never been in any gangs. I checked his facebook page....FULL of gang shit.

    Talk about disappointment. I will admit I lost some respect for this girl. Non teachers have no idea what goes on in public school.

    I dunno, it still seems excessive to me to have the cops come and incarcerate a kid that age over such a matter. If he was a gang-banging OG thug I could see it but that scrawny dude looks like he couldn't fight his way out of a paper bag. He looks terrified in the photo, too.

    Btw: I'm married to a woman who has to deal with "problem" kids all day long as a special ed teacher. I've heard the horror stories many times...something about this doesn't smell right though.

    There's not enough background info to support the story. It's kind of like the article wants to present it as way over the top. If there were more info, that would help.

    Like I said, the kid may have been an asshole all through school and the teacher hadn't received any help from the parents or admin. and finally got tired of all his shit and decided to make it so the parents and admin would be forced to deal with it in the only way left open for the teacher.

    Now, the parents are forced to deal with the actions of their kid. Sometimes, shit just builds up until only extreme actions are left as options.

    Kind of reminds me of that California kid who killed some of his buddies in a car accident and pleaded some weird affluency excuse and the judge bought it. This incident just might prevent this from happening to this kid. Hopefully, he'll learn his actions have consequences.

    This goes to show how much our society has changed since I was a kid in school. Back in the 60's the nuns would pounce on any little trouble-makers from the get go. They really did use yardsticks & pointers to bat people on the shoulders. If that didn't work then the priests were called in to administer some serious corporal punishment...and nobody's parents would dare complain about it either. Just the opposite, lol.

    The issue is some kids refuse correction, they're never wrong and if they're called on it, or worse yet are punished, instead of accepting responsibility for error they rage and plot revenge.
