A U.S. Border Patrol agent has been sentenced to two years in prison for improperly lifting the arms of a 15-year-old drug smuggling suspect while handcuffed — in what the Justice Department (http://www.washingtontimes.com/topics/department-of-justice/) called a deprivation of the teenager’s constitutional right to be free from the use of unreasonable force.


Agent Jesus E. Diaz Jr. (http://www.washingtontimes.com/topics/jesus-e-diaz-jr/) was named in a November 2009 federal grand jury indictment with deprivation of rights under color of law during an October 2008 arrest near the Rio Grande in Eagle Pass, Texas, in response to a report that illegal immigrants had crossed the river with bundles of drugs.


In a prosecution sought by the Mexican government (http://www.washingtontimes.com/topics/mexican-government/) and obtained after the suspected smuggler was given immunity to testify against the agent, Diaz (http://www.washingtontimes.com/topics/jesus-e-diaz-jr/) was sentenced last week by U.S. District Judge Alia Moses Ludlum (http://www.washingtontimes.com/topics/alia-moses-ludlum/) in San Antonio. The Mexican consulate (http://www.washingtontimes.com/topics/mexican-consulate/) in Eagle Pass had filed a formal written complaint just hours after the arrest, alleging that the teenager had been beaten.


Defense attorneys argued that there were no injuries or bruises on the suspected smuggler’s lower arms where the handcuffs had been placed nor any bruising resulting from an alleged knee on his back. Photos showed the only marks on his body came from the straps of the pack he carried containing the suspected drugs, they said.


Border Patrol agents found more than 150 pounds of marijuana at the arrest site.

This is another one that just blows my mind. It really makes me wonder if our government is sending a message to our boarder patrol agents not to do their jobs. If that is the case it makes you wonder if the cartels are having luck bribing US officals into charging the boarder patrol agents for basicly doing their job.

This is another one that just blows my mind. It really makes me wonder if our government is sending a message to our boarder patrol agents not to do their jobs. If that is the case it makes you wonder if the cartels are having luck bribing US officals into charging the boarder patrol agents for basicly doing their job.

The Mafia stayed away from drugs for many years cause they knew the massive amounts of money would further corrupt the already corrupted. Certainly the cartels have bribed "US officials" as they would be easier to corrupt than mob guys. Mob guys faced a virtual certainty of punishment while "US officials" are more likely to be promoted or retired with full pay and benefits if caught.

That level of couruption is exactly the type of thing that causes troubles like Mexicio. When no one in power is willing to do anything about it and, the rest aren't allowed to you have a recipie for any type of disaster. It also makes me wonder if this is why congress drags its heals when it comes to building a fence. yet not so long ago they were talking about building a fence along the boarder with Canada.

We can't secure the border. We can't round up the illegals here in this country - they have rights! They get all the benefits of citizenship with none of the responsibilties.

Mexico treats their illegals like shit. They have no rights.

We can however, jail one of our own border agents for nothing. For lifting a drug smuggler's arms "improperly".

It's getting very close to whoop ass time.

Except the right to own a firearm. Even green card holders do not get that right.

Actually they can. This was a topic not to long ago on another board and I found this.


Federal Issues:

In general, non-immigrant aliens are forbidden to possess any firearms or ammunition. But there is a big exception for a legal alien who:
...is in possession of a hunting license or permit lawfully issued in the United States
(See Title 18, USC Chapter 44, Section 922 (http://frwebgate.access.gpo.gov/cgi-bin/getdoc.cgi?dbname=browse_usc&docid=Cite:+18USC922), part (y)(2) for details.)


Green-card holders and immigrant aliens who do not yet have their green card are both okay under federal law, although many people (including gun dealers, law enforcement officers, etc.) are not aware of the distinction or the hunting license exception, and erroneously think that either you have a green card, or you can't have guns.



Also, non-citizen cannot purchase a firearm from a federally licensed firerams dealer unless they have been a resident of their state for 90 days. So, no, tourists on short visits cannot walk into guns stores to get "protection" during their trip. Sorry. (I've been asked that multiple times.)

I'm not being a smart ass here but I can tell you why there is no fence. Congress does not want a fence is why there is no fence.

I can also tell you why we owe almost $15 trillion dollars. Because congress wanted us to owe almost $15 trillion dollars.

Now see if you can guess why we have no Guest Worker program !!;)
