Rules Eased on Gun Sales to Noncitizens

WASHINGTON — The Bureau of Alcohol, Tobacco, Firearms and Explosives (http://topics.nytimes.com/top/reference/timestopics/organizations/b/bureau_of_alcohol_tobacco_and_firearms/index.html?inline=nyt-org) is relaxing restrictions on the sale of guns to noncitizens because Justice Department lawyers have concluded that the rules had no legal basis, officials said on Thursday.

In a letter (http://www.atf.gov/press/releases/2011/12/122211-atf-open-letter-state-of-residence.pdf) to firearms dealers on Thursday, the bureau said it would soon drop a regulation that bars the sale of guns to noncitizens until they can document that they have lived in a state for at least 90 days, such as by producing three months of utility bills in their name at a local address.

They go after Sheriff Joe,use fast&furious for their own bullshit agenda and now this,selling firearms possiably to illegals as long as they have proof of paying a light bill for 90 days? Eric Holderman and his cronies must be from Mars. A real law abiding citizen has to jump through huge loopholes and now this? The current DOJ is a fricking joke to be sure. This yr will be one of the dirtiest on record for politics im afraid. Its going to be sickening to watch. Sheriff Joe has a huge fight on his hands because they(the DNC) want illegals votes,what a mockery of existing laws, hell what laws? who am i kidding,just the ones they want to use at any given time. They will rule the day when they really screw something up and they seem to do it daily. The guy needs to be impeached.

If anyone had any doubts about how the courts’ view of the Second Amendment to the Constitution, it should be quite clear by the recent decision of the Eighth Circuit Court of Appeals, decision which concurred (http://newsandinsight.thomsonreuters.com/Legal/News/2011/12_-_December/Summary_Judgments_for_Dec__16/) with the Fifth Circuit ruling in United States v. Portillo-Muniz (http://docs.justia.com/cases/federal/appellate-courts/ca5/11-10086/11-10086-cr0.wpd-2011-06-13.pdf?1308032165), that Second Amendment protections do not apply to illegal aliens (who are specifically barred from possessing firearms by 18 U.S.C. § 922(g)(5)). I see someone at the back of the class has their hand up…you have a question? You want to know why people who are here illegally should be granted the same rights as citizens? Excellent question…

Illegals should not be granted the same Constitutional rights as citizens for the same reason citizens should not be ‘granted’ these rights: Because our the rights listed in the Bill of Rights are not granted by the Constitution or the government, they belong to us by virtue of being human beings. Anyone remember this bit?

I BET $$ that if you (American citizen) go to another state and try to buy a gun with or without utility bills, you will be denied without a Driver License of that respective state.

We applied “intermediate” scrutiny in Reese, 627 F.3d at 802, which involved a Second Amendment challenge by a citizen to 18 U.S.C. § 922(g)(8), the provision forbidding firearms to those subject to a domestic-protection order. If we assume that an illegal alien like Mr. Huitron-Guizar, who has been here for decades and nowhere else, is entitled to the lawful exercise of this enumerated right, and if we observe that the law here not only burdens but eliminates the right by placing, on a class of perhaps millions, a total prohibition upon possessing any type of gun for any reason, “intermediate” scrutiny would seem to apply. Id., at 800 (comparing burdens imposed by the various § 922 restrictions). Under this standard a law is sustained if the government shows that it is “substantially related” to an “important” official end. Id. at 802.

The “principal purposes” of the Gun Control Act of 1968 are to “make it possible to keep firearms out of the hands of those not legally entitled to possess them because of age, criminal background, or incompetency, and to assist law enforcement authorities in the States and their subdivisions in combating the increasing prevalence of crime.” S.Rep. No. 90-1501, at 22 (1968). The alien-inpossession ban was incorporated from a predecessor statute by the 1986 Firearm Owners’ Protection Act, Pub.L. No. 99-308, 100 Stat. 449, likewise with purpose of keeping instruments of deadly force away from those deemed irresponsible or dangerous. S.Rep. No. 98-583, at 12 (1986).
