State gun-control laws override any local laws

August 30, 2010

CeaseFirePA was cited supporting the "lost or stolen" gun ordinances meant to punish gun owners who the agency wants to claim as "straw purchasers." Indeed, a number of communities, including Pittsburgh and Philadelphia, have managed to get temporary decisions allowing those communities to enact those ordinances.

There is one problem: Local officials do not have the power to do so. The reason is found in the Pennsylvania Uniformed Firearms Act of 1995. Section 6120(a) states, "No county, municipality, or townships may in any manner regulate the lawful ownership, possession, transfer or transportation of firearms, ammunition, or ammunition components when carried or transported for purposes not prohibited by the laws of this commonwealth." Indeed, the local governments have "no right of action" against those who engage in any aspect of the firearms business nor can they intrude against any firearms trade associations. Regulations can occur but it is within the powers of the commonwealth.

It stands to reason. Arizona cannot stop illegal immigration; Allentown cannot harass Allentown gun owners. The National Rife Association will resolve this problem. We can help by removing officials who would eliminate our God-given right to self-defense.
