Pennsylvania Self Defense Rights Are On The Line

Critical Legislative Alert Support Castle Doctrine law

At Issue: Discharge Petition and Floor Action – House Bill 40

McDonald, PA --(Ammoland.com)- For nearly 6 years we have ‘all’ been working to improve the use of force laws (known as Castle Doctrine) here in Pennsylvania so that gun owners would feel that they would be treated fairly ‘if’ they have to use force to defend their families with lethal force.

Unfortunately we have been frustrated by the idiosyncrasies of Pennsylvania politics. Again, we want ‘nothing more’ than what other states have: reasonable legislation that will provide important protections for ‘law-abiding’ citizens who must use protective force when confronting criminals. Thousands of volunteer organizations’ dollars and thousands of man-hours have been dedicated to this effort. Grassroots leaders of Pennsylvania gun rights organizations have bent over backwards trying to be fair in a good faith effort to accommodate critics of this important legislation.

Sadly, this legislation has been held hostage by a shrill minority in the legislature consisting of the Philadelphia Legislative caucus and certain agencies.

House to vote on 'stand your ground' gun bill today

HARRISBURG -- The state House today is expected to vote on "stand your ground" legislation that would allow people to shoot assailants in self-defense in public places without first retreating.

Under the "Castle Doctrine," people are permitted to defend themselves with deadly force without retreat in their homes. The legislation, H.B. 40, would extend that to a person's porch, car or "anywhere you have a lawful right to be," said Rep. Scott Perry, R-York County, the bill's sponsor.

Should you have a legal duty to retreat from an intruder or attacker?

Pennsylvania's "Castle Doctrine" bill, H.B. 40, has cleared an important hurdle. From The Bulletin:

The state House of Representatives voted last Tuesday for a bill to expand the legal use of deadly force in self-defense of individuals and their property...

What, someone presumes to tell them they're not allowed to do that now? And here's another outrage:

Current law also requires an individual to retreat from the threat before using deadly force if the individual is in a public place.

Pa. Senate votes to expand gun owners' rights

HARRISBURG - The state Senate gave preliminary approval Wednesday to a measure that would expand gun owners' rights and voted down an amendment that would have repealed a law that allows individuals who cannot get a gun permit in Pennsylvania to do so other states.

In a 41-8 vote, the Senate amended a bill to add the so-called castle doctrine, which allows individuals to defend themselves beyond their homes, including in their vehicles and, in essence, "anywhere they have the right to be," according to the legislation.
