Gun sales lawsuit has hurdles ahead

A lawsuit against Badger Guns filed Thursday by Milwaukee police officers wounded with guns from the store will face several high hurdles, the first if it is allowable under federal law, legal experts said.

The lawsuit was filed on behalf of officer Jose Lopez III and former officer Alejandro Arce, two of six Milwaukee police officers injured over a 20-month period with guns sold by Badger Guns or its predecessor, Badger Outdoors.

City Calls Gun Store a 'Cancerous Lesion'

MILWAUKEE (CN) - Six Milwaukee police officers have been shot by guns sold by a single gun store: Badger Guns, "one of the most notorious gun dealers in America ... a cancerous lesion on Milwaukee," the city says in county court. The city says more than 1,800 "crime guns" were linked to the store from 2006 to 2009 - more than one a day - that Badger "accounted for roughly one-third of all crime guns traced by Milwaukee police in the preceding four years," and that its owners do not follow even "minimal procedures" to stop the flood of weapons to criminals.

Badger's "constant supply of deadly weapons to the criminal market makes it a public nuisance," the city says in Milwaukee County Court.

It's silly of me I know but I am of the opinion if there is only one grocer in town than all cases of indigestion and food poisoning would emanate from that single grocery store.

If I were a policeman in that fair city I would want my mayor and police chief to shut their yaps, push for their law abiding citizens to get trained and armed with concealed or open carry weapons and for that single gun store to either open up franchises around the city or for other stores to come in to provide a decent quantity of quality arms and ammo. Every place with room for a bowling alley should be required to host a few lines of a shooting range. Just dos centavos from an old dinosaur.

Silly of me I know. I may have been born there but I sure am glad I didn't grow up there. Couple of German restaurants I enjoy there but that isn't enough incentive for me to want to get any closer to Milwaukee than I am now.

Two Milwaukee police officers file suit against Badger Guns

Brady Center filed lawsuit on officers' behalf

WITI-TV, WEST MILWAUKEE —

Two Milwaukee police officers who were shot in the face are suing the store that allegedly sold the gun used to injure them.

The Brady Center to Prevent Gun Violence filed the lawsuit against Badger Guns in Milwaukee County Monday on behalf of officers Bryan Norberg and Graham Kunish, who were both shot in the face in June 2009. They returned to work full time this summer.

Kunish and Norberg have permanent disabilities after being shot with the handgun sold by Badger Guns.

The people who shot them should have been in jail, they should have sued their bosses and the legal system that put them back on the street.

If they were legal gun sales, I see no validity to the suit. If they are contending straw sales to gangbangers or some such...we'll have to wait and see.

Gun Stores Come Under Litigation Fire

While the Supreme Court in recent terms has reinforced an individual’s right to bear arms that has not put a stop to litigation over guns.

The Wall Street Journal today looks at a relatively unusual type of gun litigation: suits targeting stores for allegedly selling guns illegally to criminals.

Badger Guns in Wisconsin (pictured) has come under particular fire.

Badger Guns to surrender license, police say

A West Milwaukee gun shop that sold firearms used to wound Milwaukee police officers and has been a top seller of crime guns is surrendering its license.

But a store selling guns will likely remain in the location on S. 43rd St. in West Milwaukee, near the border with Milwaukee. Details of that operation were not yet clear early Tuesday.

Even if these are straw sales, I'd like to know how even that makes the gun store liable. Certainly if a straw purchaser is doing very few and stopping there is no conceivable way a gun store could know that or prevent it, provided the purchaser has all his documentation in order. WI'm sure there are patterns that indicate repeated/bulk straw purchasers, but I'd be interested in learning whether similar purchase patterns by legit purchasers could be mistaken as such. If that's the case (and even, really, if not), I don't think it should be contingent on a business to report activity that MAY be suspicious but might also NOT be-- in that case the store could be making a great deal of trouble for a completely innocent person... not right, not fair, and not good for business.

Badger Gun has new name, awaits license

The new owner of the West Milwaukee gun shop long under fire because of its high number of crime gun sales, including those used to wound police officers, said Tuesday he plans to make the store more selective, not selling certain cheap guns and asking buyers tough questions.

The new owner is the brother of the previous owner of Badger Guns, whose license was revoked (http://www.jsonline.com/blogs/news/133122878.html) for breaking federal law. Badger Guns stopped selling guns Dec. 31 under an agreement with the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives.

Federal regulators found numerous serious violations at Badger Guns, prompting them to take the rare step of revoking the gun store's license last year, newly released documents show.

The West Milwaukee gun shop long has been under fire because of its high number of crime gun sales, including those used in shootings of Milwaukee police officers. The U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives revoked Badger Guns' federal license last year.
