    Question on firearms transfering......

    Had a guy offer to buy my romanian rpk off of me, and tell me he'd buy it ONLY if I agreed to ship it directly to him, as he said in texas it is legal to ship a rifle directly to another person. As in, bypassing an ffl. I replied and said FEDERAL LAW requires an interstate firearms transaction to go through an ffl, and that I had never heard of this before, and that I had to ship it through an ffl. I am selling it for 640 shipped, so the guy would be getting it cheap enough to warrent paying a transfer fee. Is it true that texas residents can sell firearms to eachother and mail them directly to eachother with no transfer or ffl involvment? Sounds like pure bullshit to me, and if so, i intend to post a public warning about the guy on gunboards....

    If the sale is within the state borders, then you don't have to go through an FFL holder. As you said, any sale across border does have to go through a transfer dealer.

    I do believe the man is correct, you may as an nonlicensee sell and ship directly to another nonlicensee in your own state, so long as state law does not prohibit it. Texas is silent on the issue.

    Found it

    A nonlicensee may not transfer a firearm to a non-licensed resident of another State. A nonlicensee may mail a shotgun or rifle to a resident of his or her own State or to a licensee in any State. The Postal Service recommends that long guns be sent by registered mail and that no marking of any kind which would indicate the nature of the contents be placed on the outside of any parcel containing firearms. Handguns are not mailable. A common or contract carrier must be used to ship a handgun.

    But I am not in state. In kansas.....So it must go through an ffl......

    Absolutely. That would mean he lied to you as you are not in Texas. Call him on it and tell him the price just went up $100 for him, if he wants it.

    If you are not in the same state it must go to an FFL. You CAN ship it directly to the FFL.

    Why yes that is in fact true (for long guns)

    Of course had you mentioned you weren't a Texas resident or in Texas I would have told you that no, a Kansas resident cannot ship to a Texas resident, and not bothered to look up both federal and Texan law

    guy claims he did not know I am in kansas, did not see it, so I am going to dop it. Just seemed very shady to me......

    sorry Kadmos, I meant no offense in any of my responses. I should have added that I am not in his state, but I had doubts that it was legal regardless of what state I am in. I appriciate you looking it up and verifying it.

    T'wernt nothin. I was mostly just funnin you. Everything you said made it seem you were in Texas. Not a big deal and I learned something that I did not know about intrastate state shipping.
