AN ACT to amend the general municipal law, in relation to prohibiting
firearms as prizes in any game of chance

The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:

1 Section 1. Subdivision 2 of section 195-d of the general municipal
2 law, as amended by section 13 of part MM of chapter 59 of the laws of
3 2017, is amended to read as follows:
4 2. With the exception of bell jars, coin boards, seal cards, merchan-
5 dise boards and raffles, every winner shall be determined and every
6 prize shall be awarded and delivered within the same calendar day as
7 that upon which the game was played. No alcoholic beverage or firearm,
8 as defined in section 265.00 of the penal law, shall be offered or given
9 as a prize in any game of chance.
10 § 2. This act shall take effect immediately.

JUSTIFICATION:
Currently in New York State it is legal to raffle off a firearm in a game of chance.
Many times games such as these are open to all individuals regardless of age.
Firearms should not be raffled off in this manner.
Firearm related violence is a significant public health and safety problem
and weapons should not be given away in games of chance.
"Regardless of age"?? A raffle winner of a firearm would still need to do a NICS check.
Where's the problem?

Any person who wants a firearm for "violent" purposes can just go to the gunstore and buy it. How is making one unavailable at a raffle going to have any relation to "public safety"?

I can just picture it... a bad guy goes to a raffle, buys a ticket and hopes to win a gun. But, someone else wins it. Now, "Oh shucks, I can't go and commit that act of violence I planned".

WHAT KIND OF DRUGS ARE THESE LEGISLATORS TAKING??? No NORMAL mind works like this......
