He might not have pulled the trigger. It is obvious there was a live round in the chamber, but he pulled the hammer back on a single action pistol, but not far enough to engage the stop and when he let go it obviously fell hard enough to fire the round.

Anyone handling a weapon without checking it first and shoots someone is responsible. You or me would've been jailed day one. There's no "the person that gave the weapon says it was clear" exception in any gun law I've ever read.
